Terms and Conditions

Welcome to Be There. These Terms and Conditions ("Terms") govern your access to and use of the Be There application and website (the "Service"), operated by Be There ("we", "us", "our"). Please read these Terms carefully before using the Service.

1. Acceptance of Terms

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service. We may update these Terms from time to time, and your continued use constitutes acceptance of any changes.

2. The Service

Be There is a real-time social platform for nightlife that allows users to:

Check in to venues and see who else is there
Share stories (photos, videos, text) tied to venues
Connect with friends and create groups
Chat with other users at the same venue
Identify music playing at venues
Use safety features including walk-me-home and emergency alerts
Earn and spend in-app coins
Coordinate rides with other users

We reserve the right to modify, suspend, or discontinue any part of the Service at any time without prior notice.

3. Account Eligibility and Registration

You must be at least 16 years old to create an account and use Be There. By registering, you represent and warrant that you meet this age requirement.

You are responsible for:

Maintaining the confidentiality of your account credentials
All activity that occurs under your account
Providing accurate and up-to-date information
Notifying us immediately of any unauthorized use of your account

We support sign-in via Google OAuth, email/password, and phone SMS through Firebase Authentication. You may only maintain one account.

4. Username Rules

When choosing a username, you agree that it must not:

Impersonate another person, brand, or entity
Contain offensive, vulgar, or discriminatory language
Include contact information (phone numbers, email addresses, URLs)
Violate any third-party trademarks or intellectual property rights
Be misleading or deceptive in any way

We reserve the right to reclaim, reassign, or remove usernames at our discretion, including inactive usernames.

5. User Content

You retain ownership of content you create and share through the Service ("User Content"), including stories, messages, and profile information. By posting User Content, you grant Be There a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your content solely for the purpose of operating and improving the Service.

You represent and warrant that:

You own or have the necessary rights to share your User Content
Your content does not infringe on any third-party rights
Your content complies with these Terms and applicable law

Stories are ephemeral and are automatically deleted after 24 hours. We are not obligated to store, maintain, or provide copies of any User Content.

6. Prohibited Conduct

You agree not to:

Use the Service for any unlawful purpose
Harass, bully, threaten, or intimidate other users
Post content that is hateful, violent, sexually explicit, or promotes self-harm
Share another person's private information without their consent
Spam, solicit, or send unsolicited commercial messages
Manipulate check-ins or falsify your location
Create fake accounts or misrepresent your identity
Attempt to gain unauthorized access to the Service or other users' accounts
Use bots, scrapers, or automated tools to access the Service
Interfere with or disrupt the Service or its infrastructure
Circumvent any security features or access controls
Use the safety features (walk-me-home, emergency alerts) for non-genuine purposes

Violation of these rules may result in immediate suspension or termination of your account.

7. Venue Check-Ins

When you check in to a venue, your presence becomes visible to other users at that venue. By checking in, you acknowledge and agree that:

Your display name and profile photo will be visible to others at the venue
Your check-in status (including arrival time) may be shown to other users
Venue owners and managers may access aggregated, anonymized check-in data
Check-in history is retained for 90 days as described in our Privacy Policy

You may check out of a venue at any time to remove your visible presence.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data. By using the Service, you consent to the practices described in the Privacy Policy.

9. Intellectual Property

The Service, including its design, code, graphics, logos, trademarks, and all other content created by Be There, is our exclusive property and is protected by intellectual property laws. You may not:

Copy, modify, or distribute any part of the Service
Reverse-engineer or decompile the application
Use our branding or trademarks without written permission
Create derivative works based on the Service

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that:

The Service will be uninterrupted, secure, or error-free
Check-in information is accurate or up-to-date at all times
Music identification results are always correct
Safety features will function in all circumstances or replace emergency services

Safety features are supplementary tools and are not a substitute for calling emergency services (112 in the EU, 911 in the US).

11. Limitation of Liability

To the maximum extent permitted by applicable law, Be There and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, profits, goodwill, or other intangible losses, arising out of or in connection with:

Your use of or inability to use the Service
Any conduct or content of other users
Unauthorized access to or alteration of your data
Any events, incidents, or circumstances occurring at venues
Reliance on safety features as a substitute for emergency services

Our total liability for any claims arising from these Terms or the Service shall not exceed the amount you paid to us (if any) in the 12 months preceding the claim.

12. Termination

You may terminate your account at any time by deleting it through the app settings or by contacting us.

We may suspend or terminate your account at any time, with or without cause, including if we reasonably believe you have violated these Terms. Upon termination:

Your right to use the Service immediately ceases
Your profile and associated data will be deleted in accordance with our Privacy Policy
Any remaining coin balance is forfeited
Sections of these Terms that by their nature should survive termination will continue to apply

13. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on this page and updating the effective date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

For significant changes, we may also notify you via in-app notification or email.

14. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Greece and the European Union, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Athens, Greece.

If you are a consumer in the EU, you may also be entitled to invoke the mandatory consumer protection laws of your country of residence and bring claims in the courts of your country of residence.
